WSU-ICAA reserves the right to terminate Stephenson at any time prior to the expiration of this Agreement for good cause shown. The term "good cause" shall include, but not be limited to: (1) violation of Stephenson's duties as set forth in paragraph (3) heereof; (2) any conduct which results in final conviction of any criminal statute (excluding traffic violations which do not result in diversion or incarceration); (3) conduct which is prejudicial to the best interests of The Wichita State University or its athletic program. The determination of such conduct shall be the unanimous decision of the President of the Wichita State University, the Athletic Director and each member of the Board of Directors of WSU-ICAA.
I'm no legal expert but not sure how much wiggle room the Adminsitration has to bust this contract. As far as dismissal for prejudicial conduct Gene only needs Beggs, Sexton or one member of the WSU-ICAA Board in his corner. Not sure if lousy coaching and poor on-the-field results would qualify as "good cause" or not, but it might be a stretch. I suppose you could try to negotiate a termination settlement with Gene which would no doubt be presented as Gene electing to retire. How much of a buyout are we willing to part with? The current contract expires June 30, 2014.
