      They would have been on a visual approach and not what we will call a controlled approach. A pilot is always ultimately responsible for the safety of the plane and its crew/passengers. If they were on a controlled approach then someone in approach would have been giving instruction to the crew but if the crew thought they had a visual of the landing strip and told approach they had visual and were taking it over at that time then approach would have given control back to the crew.
