  • A way out of this mess.

Hate to start a new topic, but couldn't find one this fit.

The NCAA is clearly at the mercy of the P4 and as of now, will side with them on anything and everything. Let the P4 and BE split off and become pro leagues.

Then form a new association and go back to the student athlete model. That would make two organizations, so anti-trust laws would no longer be applicable.

Ideally, if a school wanted to move from amateur to pro status, the NCAA would be forced to let them in and assign them to a conference. Pro schools would have to compensate amateur schools for poaching players or coaches.

Pro schools should also be required to classify students as employees making all of their compensation included tuition, room and board, etc. taxable income. The pro schools would of course get a deduction for those costs when filing their annual income tax returns.

Student athletes at amateur schools would not be classified as employees. How to deal with NIL might take a little thought. Since the great majority of NIL dollars seem to simply be pay-to-play schemes perhaps you just not allow it for the amateurs. I am not really opposed to amateur's marketing their NIL but how do you avoid it just becoming pay-to-play.

Problem is, the Supreme Court has already decided that no one can prevent college athletes from earning money, so the amateur league athletes will still be wanting NIL cash.

the LOI's could include a clause that waives all rights to NIL. People can sign contracts where they give up some of their rights.

There shouldn’t be anything that prevents someone from working a job on the side and receiving fair compensation for what they are worth. As long as they show up on time and give 110% and don’t violate the school ethics code, let them get that bag.
What the ncaa can do is cut scholarships to 6, and require walkons over a certain income threshold to pay tuition and books and athletic fees (like HS athletic fees, which help offset costs). Higher prestige schools can get you paid more, but also cost more as the athletes shoulder some of the costs of the program.

Why would they do that? Does KU want that? Does Duke want that? No. Not gonna happen.

              Then don’t.

If a student is on scholarship for music performance and gigs on the side, they aren’t punished.
If an athlete is on scholarship for athletic performance, why shouldn’t they be able to make money on the side as well?
The whole argument that they aren’t “amateurs” if they make money on the side is stupid. If someone had a thing for jazz and wanted to pay top players around the nation to come play at their school, paid for instructors and band leaders to come, nobody would bat an eye. As soon as someone starts paying athletes everyone loses their mind.
We live in a capitalist society. Why are we advocating for the highest of socialist ideals? Let the market work it out and it will find its balance.
