    If they were in fact intoxicated I hope charges are filed.

    I honestly wish punishment for such foolish behavior was more severe than it is.

      Man are you going to get in trouble by saying something like that!

      These innocent young rascals were just out having fun getting ready for a hunting trip, never mind that there were multiple laws broken, they should be given a break.

      Drunk driving, underage drinking, just a couple of guys out having fun and you are attacking them.

        Had the driver lost control of his car and killed a family in another vehicle would you still go with the young kids having fun slant?

            I dont think they are bad fans. I think they are legitimate questions and opinions. I personally wander how charges can be brought if their was no damage to property or person other than the two in the vehicle. Unless the passenger wants to file charges against the driver which i dont think they would have a case either i dont know how charges would be filed. Laws are broked everyday that go overlooked. I guess this just confuses me.

                  First of all, outside of fuball7, I don't believe anyone was saying that the guys did not use poor judgement and bad decisions and that they should not be held accountable. The only issue earlier with JJClamdip was that I think some posters thought it was a bad timing to pile on so soon. In any case, I think it is obvious that charges should and will be filed if the results of their blood tests are positive. I'm not even sure the authorities have any leeway in that regard. Charges should be filed if they broke the law. The reason for doing so is deterrence. They certainly should receive no preferential treatment just because they are college athletes.

                  Kansas has a diversion program that allows you to avoid conviction if you plead guilty and fulfill the requirements of the diversion program. Not sure if Oklahoma has a diversion program or not.

                  If they do not, here is what they may be facing assuming this is a first offense which AFAIK it is:
                  Learn the potential penalties for DUI, DWI, APC, and other alcohol-related driving offenses in Oklahoma.


                  Tobin Mateychick did turn 21 on this past August 13th. So he no doubt was the person who purchased the booze for himself and on behalf of the other 3 underaged participants. McGreevey just turned 21 on December 11th. Not sure if this puts Tobin in a different light legally in terms of charges and responsibility or not. It may have some impact, but it certainly does not excuse the actions of the younger guys.

                  How much damage they have done to their baseball careers remains to be seen. Zach's injuries sound quite serious and who knows whether he can recover to the point of being able to play again. Clearly, Gene has some decisions to make to what extent he will penalize the guys and give them a second chance assuming they are willing and able to play.

                  My feeling is they deserve a second chance if they want it assuming they have been adequately held to account for their actions. In addition, Gene will have to deal with TJ McGreevey and Casey Gillaspie who were back at the hotel as they have some music to face also.

                  Hopefully they will fully recover from their injuries, they will be held accountable and take their medicine like men, they will learn from this experience and move on to live productive and successful lives with or without baseball.

                    If I was Gene I would throw them all off of the team but he won't.

                        I wasnt saying they didnt use poor judgement. They most certainly did. I actually was agreeing with the people that were saying that it wasnt alright that they were just out having a good time. It was not a smart decision. I was commenting on charges being brought. I was saying I didnt know how charges can be brought for injuring themselves. I know driving under the influence is illegal. Not everything that is illegal has charges brought on it. I just didnt see how charges can be brought on them for injuring themselves.

                            I do have a question. Why in the world does it take a month (and still counting) if this account is accurate to get the results of a blood alcohol test? Not that this is necessarily that important one way or the other but just struck me that this is an excessive amount of time to wait for what I assume is a pretty simple blood test. Maybe this is the norm. I happily have no 1st hand experience with this process.

                              Maybe if you cannot get them to "blow" at the scene you have to do blood work to determine what they are impared by?

                              I also thought that was odd that it takes so long, maybe Gene has his "Oklahoma connections" slowing the process down?
