    A lot of states have made it illegal. It's a pretty common misconception that it's illegal everywhere. Federally, there's no protection.

    My point about sex discrimination will get you sued everywhere, though. If you fire someone for being gay in Kansas, I'd say you're more likely than not going to get sued under the theory I presented. Last I knew, most courts weren't buying it. It's going to be an interesting development over the next few years.

        Definitely for being white. None of the rest would be illegal probably, but I bet you could get some attorneys to take the hair loss case as an age or sex-based (more strongly correlated with being a male) claim. I think you'd have a loser on your hands, though. Some states protect party-affiliations, too.

          What if I get fired because I like to make sweet love to a real purdy sheep? How about the chickens? Puttin' the sausage in a hole in the bathroom stall at that Indian run gas station down on the border of Oklahoma and Kansas (second stall over with the rusty lock and a coin-op lube dispenser)? How about for JOKING with a peer about putting the sausage in a hole in the bathroom stall at that Indian run gas station on the border? Same joke with your secretary?

            I did not know this until recently, but it is illegal to pork an animal in Texas, one of Harris County's finest found that out the hard (pun intended) way......


            I guess you could call that a new way to screw ole' shep.

                  It should be illegal to fire someone for non-work related offenses. Firing someone that is gay for work related offenses should be easy. I've had gay and steaight workers that were good and gay and straight employees that were bad at their job. It never crossed my mind to fire any of them for sexual orientation.

                    So you think it should be illegal for an employer to fire someone for what they do on their personal time? If they are off the clock, legal or illegal activity, it's of no concern to their employer?

                      There's a tough line that needs to be walked. You need business owners to be able to make a pretty broad range of hiring and firing decisions. If a lay-off is needed, the employer might have to choose between two qualified people. Employment-at-will is the policy in the vast majority of states. You also want to protect employees, though.

                      I think that's probably part of the justification for having specific provisions in place rather than a blanket law regarding what can and cannot lead to a termination.
