Word is that the FBI is investigating the security of Clinton's email server. I think that's appropriate for several reasons, chiefly among them is 1) they will examine as to whether FISMA baseline standards were used (the server was properly hardened and configured - note that any federal department and contractors are required to either have their systems compliant (and I'm guessing that this one would rate as a 'high' system) or have a waiver) and 2) if this becomes a criminal investigation, they have the ability to obtain subpoenas, search warrants, and are qualified to handle any evidence collected in case there IS a prosecution (note that if the 'chain of evidence' prosecutorial rules are not followed, it could be thrown out of court).
However, I would not be surprised if a waiver magically appeared (perhaps backdated as well?).
