TRO's are extremely easy to get. Tell the judge anything. Complainants have "advisors" who will assist in making sure the right things get said.

Since there's no real "legal" harm to the person on the receiving end of the TRO (just stay away from the person making the complaint), it's almost an automatic process: 1) File any complaint - 2) Judge rubber stamps.

The hearings are also a bit of a joke and incredibly one-sided in favor of the person who made the complaint. Again, there's no "legal" harm to the person on the receiving end, so the tendency is to issue either a permanent order or an extension.

A friend of mine had this happen to him. I showed up as one of 3 witnesses to counter the "facts" presented in the original complaint. His soon-to-be-ex-wife was allowed to change her story at the hearing and present a different set of "facts" that eliminated the witnesses for my friend. He wasn't even allowed to have the witnesses say she lied in the original complaint to demonstrate she was just making things up as she went through the process.

Restraining Orders are incredibly easy to misuse to make the "offender's" life a living hell. In my friend's case, the soon-to-be-ex-wife trolled every place he was known to go outside of work. If she showed up - HE HAD TO LEAVE! Then she'd leave to see if whe could figure out where he was going next.

In order to lead a reasonably normal life, HE HAD TO GO TO COURT, file information on where he was going to be, when he was going to be there and eventually got a modification to the order so that she couldn't enter a public place if he was already there.

Restraining orders are given for everything ranging from legitimate life-threatening situations to situation where the complainant uses the system to disrupt and harass the "offender".

There is no "legal" harm, but the public sees a RO as a moral issue and there can be substantial public relations fallout. For proof, just look at the number of people predicting the end of Gene's coaching career when they have no facts in the situation and will probably never know the facts.

The case was reported on Fox news tonight.

Gene issued a statement saying the accusations are not accurate.

The accuser (whose name was given) will now have to present evidence of the facts at the May 1st hearing which will determine whether the restraining order stays in place.

It is strictly a civil matter between the parties involved unless the order is violated, which could be a criminal offense.

Don't shoot the messenger. It's news. Paul reported on the facts. If he didn't, he wouldn't be doing his job.

I absolutely hate it when the media manufactures the news, but I don't see Paul doing that in this case.

So if this gal shows up at home game...Gene will have to leave the ballpark? Can you imagine the kind of problems this gal can create as Gene schedule is pretty much public information.

Additionally, I saw a copy of the tro on tv. I also saw a / the womans name on it but I won't publish it here. Given that information and what I know, I don't believe this allegation by a long shot. That's all I'll say.

If she shows up where Gene works or any other place known to the public (radio shows, etc.) then it's generally interpreted that she willfully violated her own request.

Going out to eat or to social gatherings not generally known to the public is where she can cause Gene to leave. She has a right to be in public places and "no reasonable expectation" of running into Gene.

When my firend had his TRO, in addition to going to court and listing locations he would be and the schedules, he also worked it out with the management of those places that basically got her banned.

If repeated phone calls is all it takes, then half the kids recruited by Kelvin Sampson could have gotten restraining orders against him.
