ESPN - Terrence Shannon files for restraining order against Illinois

Terrence Shannon Jr. filed for a temporary restraining order Monday that demands his school "immediately reinstate" the Illinois basketball player who was suspended indefinitely from all team activities last month following an arrest on a rape charge, his lawyer, Mark Sutter, told ESPN. The charge stems from an alleged rape in September.

Shannon's lawsuit, filed by Sutter and his legal team in the Sixth Judicial Circuit Court in Champaign, lists the Illinois board of trustees and school president Timothy Killeen as defendants.

After a warrant was issued for Shannon in Douglas County, Kansas, last month, he submitted to authorities and was briefly jailed before posting bail and returning to Champaign.

According to the initial complaint, Shannon was charged with "unlawfully, feloniously, and knowingly engaged in sexual intercourse with a person ... who did not consent to the sexual intercourse under circumstances when she was overcome by force or fear, a severity level 1 person felony."

The temporary restraining order, a copy of which was obtained by ESPN, claims Shannon was not granted due process before he was removed from the team. He is set to be arraigned Jan. 18, but the trial for the case would not begin until June, after the conclusion of the college basketball season.

"Does the presumption of innocence really mean anything? That question is at the heart of this case," the lawsuit states. "Illinois has promised [Shannon] that it would adhere to this presumption, but in practice Illinois has not applied it by suspending [him] and ruining his career as if he were already convicted. [Shannon] maintains his innocence, for the record. Sexual assault is a horrific crime, and [Shannon] is appalled that his name is mentioned in the same sentence with such a crime, and he in no way seeks to minimize that it is a real problem."
The presumption of innocence is crucial in the pursuit of justice. However, I don't think that means that others outside of the justice department/courts have to go along with business as usual. What kind of risk does Illinois face if they allow him to continue being a part of the team and he sexually assaults someone else?

Does anyone else ever get the benefit of the doubt so it doesn't impact their professional careers/aspirations? Hell, I know one story where an airline pilot was illegally detained and charged with DUI, even though he showed zero indications of being intoxicated and blew 0's and even though all of the evidence pointed towards the charge being BS, his professional life as a commercial pilot was severely impacted as there's a zero tolerance policy there. The charge was made because PDs get money from the US government for DUI charges/problems in an area.

I'm not saying Shannon is guilty as I have no idea, but I see zero problem with him being suspended until things are figured out. It's a lot less harmful to him than it is to many who may be immediately fired for simply being charged/arrested for something. If he is found not guilty, he will still have every opportunity to play at the next level, though maybe it gets delayed by a year. If he's found guilty, he still may get the opportunity. It's not like the NBA hasn't made a lot of scumbags wealthy because they can play ball.

The rape and hard drug culture at KU is so bad, that even players on other teams are getting arrested for rape. I don't think the average Kansan has any idea how bad it really is up there. There's NO WAY they would let their daughters go to KU if they knew.

ESPN - Judge holds off on ruling in Terrence Shannon Jr. case vs. Illinois

A federal judge has delayed ruling on Illinois basketball star Terrence Shannon Jr.'s request for a temporary restraining order and immediate reinstatement following his indefinite suspension after an arrest on a rape charge last month.

U.S. District Judge Colleen R. Lawless heard from both sides Friday and said she will take the case "under advisement" and rule at a later date.

Shannon's attorneys said they had no comment when contacted by ESPN after the hearing.

Earlier this week, Shannon filed for a temporary restraining order against the university in an effort to be reinstated. The lawsuit, filed in the Sixth Judicial Circuit Court in Champaign, alleges that the university rushed to judgment and did not follow its protocols when it suspended him from all team activities. The filing also said Shannon had been told by Illinois officials that he will not be considered for reinstatement until his legal case is resolved -- which might not happen until the summer -- and that forcing him to miss to rest of the 2023-24 season would do him "irreparable harm" and impact his future earning potential in the NBA.
If Shannon is granted his restraining order it effectively prevents the University from ever suspending any student for anything regardless of how credible the accusations are.

        Slippery slope

ESPN - Terrence Shannon Jr. returns for Illinois after judge's ruling, scores 16

Terrence Shannon Jr., in his first game back after a judge's ruling allowed him to rejoin No. 14 Illinois, scored 16 points in an 86-63 victory over Rutgers on Sunday.

Shannon came off the bench and played 28 minutes. He had four assists and made 8 of 10 shots from the free throw line.

He was suspended by the university on Dec. 28 after he was arrested on a felony rape charge for an alleged September incident in Lawrence, Kansas. U.S. District Court Judge Colleen Lawless, however, ruled Friday that the university had violated Shannon's civil rights and granted a preliminary injunction that required Illinois to reinstate Shannon to the team.

A preliminary hearing in the criminal case has been set for Feb. 23.

Illini fans showed support for Shannon by cheering when the guard entered the court for pregame warmups and giving him a standing ovation when he checked into the game with 17:37 to go in the first half.

"Our team feels whole again," teammate Justin Harmon said after the game. "We have our best player back."

ESPN - Ex-Illinois star Terrence Shannon Jr. faces felony rape trial

Former Illinois star Terrence Shannon Jr. will stand trial on first-degree felony rape and felony sexual aggravated battery charges June 10, a Kansas judge ruled at his preliminary hearing Friday.

Shannon was arraigned and pleaded not guilty before a judge ruled there was probable cause for trial to proceed in his case.

Last year, a woman accused Shannon of sexually penetrating her with his fingers at a bar in Lawrence, Kansas, on Sept. 9. The woman found Shannon's picture through a Google search and told local police he was the assailant. Shannon was arrested and charged with "unlawfully, feloniously, and knowingly [engaging] in sexual intercourse with a person ... who did not consent to the sexual intercourse under circumstances when she was overcome by force or fear, a severity level 1 person felony."

In December, Shannon was suspended indefinitely by Illinois and missed six games, but he was granted a temporary restraining order by a federal judge and returned to the team Jan. 21. He played the rest of the season and led the team to the Elite Eight. In April, the university dropped its investigation of Shannon.
