  • Shocker Lawyers - No-Spin Opinion on Kagan?

I have read some stuff on Kagan. Some that make me wonder about her, some that doesn't make me think she is a crackpot.

Alot of things that are brought up are when she was solicitor general - which may not be fair to totally judge her on because her job is advance and defend the government position.

So what is your take on Kagan?

Everyone should be aware that she simply idolizes Obama like a 12-year-old girl and called him her "hero".

By now, anyone with a working knowledge of narcissism recognizes the pathological condition of the president.  Even liberals concede that the man who sends thrills up Chris Mathews' leg is self-absorbed.  It therefore makes sense that...

Confirmation Messes, Old and New by Elena Kagan

In the law review article linked to above Kagan argues that Supreme Court confirmation hearings had become a “vapid and hollow charade” because nominees studiously avoid answering direct questions about their views of specific constitutional issues. Nominees say little about their judicial philosophies beyond empty platitudes. She is correct, of course. The conventional wisdom is that, now that she is in the “hot seat”, she will not hold herself to the standard she argues for in the article. Cynically, I tended to agree with that point of view but then I read this:

Kagan: Confirmation Hearings are a "Charade"

If Kagan really wants these hearings to be a “teachable moment” (I am already sick of this phrase) – it should be interesting and I will withhold judgment until the hearings are held. Tell us what you think Madam Kagan. :good:

BTW – she is, by all accounts, very bright. I doubt the Senators questioning her are her intellectual equal. Furthermore, if she chooses to engage the Senators they are playing on her turf.

She is going to be confirmed, so I havne't spent a lot of time analyzing her nomination.

NY Representative Louis Slaughter has found a 1997 Kagan memo troubling. Kagan had written Bill Clinton to back a ban on Late-term abortions.
