Hotel Conference Center May Trump Private Property in Eminent Domain Case

In Auburn, New York, the city is threatening to invoke eminent domain to seize private property for a private hotel conference center, saying the public good outweighs the private property rights of some citizens.

But five years ago the United States Supreme Court ruled that communities could use the power of eminent domain to help private interests, if the result was for the public good. The case centered on New London, Connecticut, where a neighborhood was razed to make way for a private development that never came.

The SC screwed up on that one. Maybe I need to go back and read more about eminent domain but I'm pretty sure it was never meant to be used like it has been lately.

I agree, the SC screwed the pooch with this one. I was thinking eminent domain was what would give the gov't the ability to buy up land to build roads/highways etc, not be used to redistribute land/property from one private citizen or group to another one that "promises" *wink* *wink* that it will provide a greater good to the community.

The biggest problem is there is becoming an increasingly diminishing number of normal people to decipher between right and wrong and carry the water for the eggheads that can't do and the welfare state that won't do.

The Kelo case redefined "public purpose" so broadly as to allow situations like this.

However, the US Sup Ct said that states can enact their own restrictions.

Many did.

Kansas' restriction is that it would take an act of the Legislature to approve anything like this.

It isn't perfect, but it is a fairly large political hurdle.
