    BREAKING: Penny Jurors Say They're Locked on Top Charge - How Did We Get Here?

    Jurors in the Daniel Penny trial informed the judge Friday morning that they're unable to come to an agreement on the top charge. The judge gave them some additional instructions and sent them back to deliberate further.​

    As I (Bob Hoge, the author) wrote previously, the case highlights everything that is wrong with today’s justice system in too much of America:

    Who and what is at fault here? It’s not Daniel Penny. You could even argue that it’s not even Jordan Neely.

    It’s woke politics and progressive policies. It’s leftist politicians and soft-on-crime, George Soros-backed prosecutors like Manhattan’s Alvin Bragg—whose office filed this abomination—who put those passengers in danger. Who put Penny in a position where he had to use his hard-earned skills to protect his fellow New Yorkers.

    What in the hell was Neely doing out on the streets
    It's unsettling, to say the least, that the jury has so far been unable to agree on the fate of Penny, who faces up to 15 years in prison, and it boggles the mind that at least some of the jurors evidently want to put him behind bars. It's a sad reflection of the New York state of mind when its own citizens advocate for its further decline.

    I was wondering why this was taking so long. In a normal and sane world it should have taken the jury about 5 minutes to return a verdict of not guilty on all charges.

    If they do find Penny guilty or even end up with a hung jury and a new trial one of the first things I would do if I were Donald Trump is to pardon Penny and award him the Presidential Medal of Freedom.

      It's sad what has happened to the great city of New York since Mayor Giuliani's time. There definitely needs to be tougher patrols.

      It appears in this Marine's situation, a 6 minute chokehold (even after the perp was motionless) is a bit too much to be given the all clear by authorities.

      There needs to be a fear of loss of life, then lethal force is allowed until the threat is eliminated. I'm guessing they are having an issue with one of these factors.

      There is a possibility that the Marine just got really annoyed and aggressive without anybody feeling criminally threatened.

      I've got a buddy in NYC that says junkies on the subway acting crazy is pretty much a daily thing.

        In a bizarre twist, after the jury returned another note to the court indicating it remained deadlocked on Count I, the prosecution moved to dismiss the count (for second-degree manslaughter) and asked the court to instruct the jury to continue considering Count II (negligent homicide). The defense objected, contending that this move was coercive, but the judge ultimately determined to proceed in that fashion. The judge dismissed the jury, telling them to return Monday to continue deliberations as to Count II.

        ADA Yoran: Don't tell them it's an acquittal (on Count 1), only that it's dismissed. Penny's lawyer Kenniff: This has never been done before. It would encourage prosecutors to over-charge in thend jury, with the option of withdrawing if hung, under coercion

          This whole thing is disgusting. The same people gasping at Penny killing this dude are cheering the murder of the insurance CEO. We live in a very effed up world.

            Personally, I do not think Justice has been servced. The process is the penalty.

              The racial makeup of the jury in the Daniel Penny trial is as follows: - **White:** 7 -......... **Black:** 2 - .....**Filipino:** 1 - ......**Middle Eastern:** 1 ......- **Hispanic:** 1 ............... 7 women, 5 men

                Something that doesn't make a lot of sense to me. Last week the jury could not come to a unanimous agreement on the more serious and harder to prove second degree manslaughter charge so the judged dismissed that charge and had the jury to return today to consider the secondary charge of negligent homicide. All of a sudden the jury had not problem coming to a unanimous verdict of not guilty on the lesser charge. Something just doesn't add up in my pea brain. Thank goodness the jury got it right, although you wonder how that came about.

                    I'm guessing there was one ass hole with an agenda holding out, but when the more serious charge was dismissed, this individual gave up.

                      Didnt the mayor finally say something reasonable about how dumb this case was and say Penny shouldn't be on trial? Can't remember, but it seems Adams is starting to come around on a lot of things.

                          I can only hope that this is a preliminary charge while they put together all of the real evidence before bumping it up to first degree. There's little doubt that this was premeditated and in cold blood based on what I've seen released.

                          I know it's not uncommon to start with a lower charge to get the process moving and add to it once everything in compiled. If he only goes on trial for second degree then there are major issues.

                            From my understanding the question posed to the judge between the two notices that the were hung was about the justified use of force.

                            The jury was instructions stated that if they found he was justified in count one they couldn't consider count two.


                            So it seems there was a single member holding out and over the weekend came to the conclusion that it was justified. Or the dropping of the charge had the opposite effect then the State wanted, it caused the jury to say NG count one then must be NG count 2. Or he was ready to go home and just said fine I'll go alo g with NG. Only tge members of the jury know.

                              Now Daniel Perry may be facing a civil lawsuit from Jordan Neely's father/family who was/were nowhere to be found prior to NYC charging and prosecuting Daniel Perry. Hopefully, that goes nowhere and is resolved quickly and Daniel Perry can get the hell out of Dodge.
