This isn't as clear cut an oddity as it may seem. First, the article you link to does not mention that she was suicidal that day and intentionally hit the guard rail. In other words, it wasn't an accident, it was a willful act that could have been prevented and that would have protected the rescuers from injury.

Also, they are asking for $25,000 each. Really! Just $25,000? If I had a "bad day" that caused physical harm to two individuals who tried to save my life is that to much to ask? Would you not feel financial responsibility for their injuries?

They maybe have to sue her if she had no, or inadequate, insurance or to start proceeding against her insurance company.

I have to admit, I don't see a problem with suing this lady. She wrecked her car on purpose and was trying to kill herself. This was 100% her fault, not an accident, therefore she should be liable for damages she caused.

Another perspective. I remember hearing about a similar event. A college student went to an unofficial college event (organized by some students, not the college)at a pond but off campus, where he was playing around and dove into the shallow pond and broke his neck. His injuries paralyzed the student from the neck down, and changed his life. His care was going to be so expensive that it was going to bankrupt the family to take care of him. From what I heard, the college encouraged the family to sue them so that their insurance could help. The college wanted to help in any way they could.

That is interesting. Maybe the lady's family told them to sue her...but I would guess car insurance wouldn't cover this...and if it did, I would assume they'd be tring to get more than $25k, unless that's all insurance will cover. hmmmm
