Obama to pick Sotomayor for Supreme Court

WASHINGTON - President Barack Obama tapped federal appeals Judge Sonia Sotomayor for the Supreme Court on Tuesday, officials said, making her the first Hispanic in history picked to wear the robes of a justice.

If confirmed by the Senate, Sotomayor, 54, would succeed retiring Justice David Souter. Two officials described Obama's decision on condition of anonymity because no formal announcement had been made.

Administration officials say Sotomayor would bring more judicial experience to the Supreme Court than any justice confirmed in the past 70 years.

A political centrist, the Bronx-born Sotomayor has been regarded as a potential high court nominee by several presidents, both Republican and Democrat.

With all due respect, I have personal experience with Judge Sotomayor, having appeared before her, and she is far from a centrist.

Before you come to any conclusions about Judge Sotomayor, you should look into her background yourself. In other words, you should explore what she has actually said and done in a professional capacity instead of solely relying on what others might say about her.

I suggest you start by reviewing the procedural history of Ricci, et al. v. DeStefano, et al.

Her comment about making law, in my opinion, is reason to exclude on sight.

A terrible nominee, and a slap in the face to right thinking Americans, essentially saying "Nay nay de boo boo, there is nothing you can do about it".

To be slightly more accurate, although not exact (I don’t recall the quote), I believe she said something akin to: The Second Circuit is “where policy is made”.

Being appointed by President George H.W. Bush does not make one a centrist. I would be hard put to fine a person who would call Justice Souter a centrist.

I wonder if there are instances where conservatives (right wing radicals if you may. I don't but for the sake of arguement you may) don't show their true "colors" so to speak until they get where they want to be and then go nuts....If not, I wonder why?

Federal Appellate Judge Sonia Sotomayor, nominated May 26 by President Barack Obama to the U.S. Supreme Court, has earned a centrist reputation in business cases: In 1995, she sided with Major League Baseball players in a confrontation with owners over free agency and arbitration, but 11 years later she rejected a petition by millions of investors that alleged rigging of initial public offerings in the dot-com boom.

"Judge Sotomayor has a track record of moderation on issues of importance to the business community," said Evan M. Tager, an appeals specialist at Mayer Brown in Washington, D.C.

In class actions, Sotomayor has occupied a strict middle ground, her record reflecting sympathy neither for those in favor of such issues, nor skepticism of them. "She looks at each case on its unique facts to determine whether a class action is appropriate," said Tager.

Another hot-button issue is preemption, or the right of federal courts to step in to cases involving state law. Tager said on this issue, too, Sotomayor has been centrist. "She has been evenhanded in cases raising federal preemption as a defense, finding preemption about half of the time and rejecting preemption about half of the time," Tager said.

I don't know whether she's a centrist, moderate, liberal, or whatever. I guess it depends on the issue. It sounds like she's a centrist on business issues.

She's also on record saying something along the lines that being a latin woman allows her to make better rulings than a white man.

I'll have to find the exact quote but our internet has been hit and miss today so no guarantees until I get home.

I will look into the business angle; however, the major league baseball decision was an easy one. Admittedly, I am not familiar with every decision Judge Sotomayor has made.

When I wrote you should look into Ricci v. DeStefano – I wrote procedural history for a reason. I don’t believe that the majority in the Second Circuit issued a substantive written opinion; however, the Order (a denial of an en banc proceeding) did contain a dissent – which was striking to read. I just could not find, and don’t have the time to locate right now, the text. If you look and find it you should post it – it was written by Judge Jose Cabranes (sp?) (a Clinton appointee, if that matters to you). I also believe the case was wrongly decided and upheld by the Second Circuit. And that it is likely to be reversed by the Supreme Court – but that was not my main point.

Not to mention the fact that it is well known that Judge Sotomayor does not have a good track record when it comes to Supreme Court review of her decisions. Put aside the identity politics and find out for yourself.

There is going to be a lot of spin in the coming weeks.
