Should the parents have been notified? Absolutely. But as a teacher, I can guarantee you I would have immediately taken this to the office and/or the SRO (Student Resource Office) in our building. Primarily due to the CYA unwritten protocol, because if something like this were left without followup, and the kid did something later, someone's butt could be hanging on the flagpole, and I wouldn't want it to be mine due to not sending this up the line. That the poor kid had to undergo a psych evaluation is so completely over-the-top it exceeds the upper limit of absurdity.

Sorry ASM, its not retarded. As I said, yes the parents should have been contacted. What if this drawing WAS another sign that this kid has serious problems? Is it retarded then? My fiance is an educator in basically the same student age demographic as this story.
I emailed her this story earlier today, and she thinks it was "completely absurd" to call law enforcement as well.
So there ya go, another educator opinion- be it second-hand.

Sounds to me like:
A black kid in a school that is predominately white. If the kid was well-behaved than it's simply racial stereotyping. If the kid is a troublemaker than it might be a case of a teacher being cautious or just trying to get rid of a problem child.
Since the teacher went straight to the police, I'm thinking the kid had a bit of an attitude problem or the teacher is a red-neck racist. You wouldn't go straight to the police if you genuinely liked the child.
